Dear hosts in the Schmallenberger Sauerland and the holiday region Eslohe,

the current developments demand a lot from all of us. In order to interrupt the chains of infection as much as possible, numerous restrictions in public life and in all our leisure time are necessary. This is of course accompanied by major economic challenges. In order to keep you as well informed as possible, we have put together some information below which we hope will help you to deal with the corona epidemic. We have compiled this information to the best of our knowledge - it does not claim to be complete! Current regulatory situationthe city of Schmallenberg

Das Auswärtige Amt der Bundesrepublik Deutschland hat seine Reisewarnung auf die Provinzen Nordholland (Noord-Holland) und Südholland (Zuid-Holland), Stand 17.09.2020. Damit ist ganz unmittelbar auch der Reiseverkehr vieler unserer niederländischen Gäste ins Sauerland stark eingeschränkt.

Hier die aktuellen Infos:

Das Ministerium für Arbeit, Gesundheit und Soziales des Landes Nordrhein-Westfalen hat folgende Bestimmungen für Reisende aus Risikogebieten erlassen, die in NRW gelten:

  • Wer aus einem Risikogebiet nach NRW einreist (bzw. sich in den 14 Tagen vor der Einreise dort aufgehalten hat), muss sich umgehend und auf direktem Weg in eine 14-tägige häusliche Quarantäne begeben. Es ist den Personen nicht erlaubt, das Haus oder die Wohnung zu verlassen oder Besuch von Personen zu bekommen, die nicht zu dem Hausstand gehören.
  • Eine Befreiung von der Quarantänepflicht ist möglich, wenn ein so genannter PCR-Test auf SARS-CoV-2 durchgeführt und nachweislich negativ ausgefallen ist. Der Test muss maximal 48 Stunden vor der Einreise durchgeführt worden sein.
  • Diese Auflagen gelten somit auch für niederländische Reisende, die in den Risikogebieten wohnen oder sich 14 Tage vor ihrer Einreise nach NRW in einem der Risikogebiete aufgehalten haben.  
  • Die Personen sind verpflichtet, sich bei dem zuständigen Gesundheitsamt zu melden (telefonisch oder per E-Mail) und dieses über ihren Aufenthalt in einem Risikogebiet zu informieren.
  • Wer sich erst nach der Einreise testen lassen will, muss dazu das zuständige Gesundheitsamt kontaktieren und in Quarantäne bleiben, bis ein negatives Testergebnis vorliegt. Für niederländische Gäste wird dies vermutlich nur im Rahmen von Wohneigentum und nicht in Beherbergungsbetrieben (inkl. Campingplätzen) möglich sein.
  • Die Pflicht zur Quarantäne gilt nicht für Personen, die sich auf der Durchreise befinden. Diese dürfen jedoch nicht in NRW übernachten und müssen NRW direkt verlassen.

Der zuständigen Landkreis ist unter folgender Hotline zu erreichen, dort werden allgemeine Fragen zum Corona-Virus beantwortet:

  • Hochsauerlandkreis: 0291-942202; Sprechzeiten: Montag-Donnerstag: 08:00-15:30 Uhr, Freitag 08:00-13:00 Uhr

Ergänzende Bestimmungen seitens des Hochsauerlandkreises bzw. Vorgaben für Gäste in Kommunen des Hochsauerlandkreises:

  • Einreisende zu touristischen Zwecken aus Risikogebieten müssen bei der Einreise einen negativen PCR-Test auf SARS-Covid-2 vorweisen da ansonsten Übernachtungsangebote zu touristischen Zwecken untersagt sind (§ 15 Coronaschutzverordnung). Hierzu zählen Hotels, Pensionen, Ferienwohnungen, Ferienhäuser, Campingplätze etc.. Der negative Test darf bei Einreise nicht älter als 48 Stunden sein und muss den Vorgaben des Robert-Koch-Instituts entsprechen.   • Das negative Testergebnis auf Corona SARS-CoV-2 ist zusammen mit den Personalien als Kopie an den Hochsauerlandkreis, Gesundheitsamt, Steinstr. 27 in 59872 Meschede zu senden. Oder in digitaler Form an infektionsschutz@hochsauerlandkreis.de (z.B. PDF oder Foto .jpg bzw. .png)
  • Sollten dennoch Symptome auftreten, die auf eine Corona SARS-CoV-2 Erkrankung hindeuten (Fieber, Husten, Verlust des Geruchs- oder Geschmackssinns etc.) ist unverzüglich das Gesundheitsamt unter Telefon-Nr. 0291/94-2202  zu kontaktieren.

Essential elements of the regulation valid from 11.05.2020:

Catering
(1) The operation of restaurants, catering establishments, pubs, bars, snack bars, (ice-)cafés, refectories and canteens open to the public and other food service establishments shall comply with the hygiene and infection prevention standards laid down in the Annex to this Regulation. Only persons belonging to the groups mentioned in § 1 paragraph 2 (families, two domestic communities, etc.) may sit together at the same table.
(2) Canteens not open to the public (except university canteens) and canteens of companies, public authorities and (training) educational institutions (including schools within the meaning of § 1 paragraph 1 of the Corona Care Ordinance) may be operated for the care of employees and users of the facility in deviation from paragraph 1 if suitable precautions are taken to ensure hygiene, control access and ensure a minimum distance of 1.5 metres between persons (including in queues).
(3) Catering establishments under subsections 1 and 2 may provide premises for events and meetings under section 13(3) under the conditions specified therein.

Accommodation, conferences, tourism
(1) In hotels, guesthouses, youth hostels and similar accommodation establishments, overnight accommodation for tourism purposes is prohibited up to and including 17 May 2020; after that date, it is prohibited for persons not resident in Germany.
(2) Overnight accommodation in holiday apartments, holiday homes and on campsites for tourist purposes is prohibited for persons not resident in Germany. The prohibition according to sentence 1 does not apply to the use of permanently rented or owned real estate and of permanently parked caravans, mobile homes, etc. exclusively by the persons entitled to use them.
(3) The standards of hygiene and protection against infection laid down in the Annex to this Regulation shall be observed in the accommodation of guests, in their catering and in the operation of communal facilities on campsites, etc.
(4) Coach travel is prohibited.

Update as of 07.05.2020

From 11 May onwards, it should be possible again:

  • Gastronomic offers in restaurants, as long as in the interior and/or exterior area the adherence to the distance requirement is guaranteed and an infection protection and hygiene concept by the companies is in place. Buffet
    offers with open food will not be permitted.
  • Tourist use and stay in holiday apartments, holiday homes and on camping sites (subject to contact restrictions).
  • Opening of leisure parks, excursion boats (with a hygiene concept), tourist information offices, bicycle and boat rentals.

Before Ascension Day, hotels will also be reopened for tourists. Strict conditions apply for this, analogous to the gastronomy with an obligatory hygiene protection concept as well as the guarantee of distance regulations and contact restrictions.

The detailed specifications and regulations are still pending and are currently being prepared.

Rinse water pipes

The non-use of premises, e.g. holiday apartments or hotel rooms, over a longer period of time can lead to the water pipes becoming contaminated and germs forming there. It is therefore particularly important, especially during such a phase, to rinse the drinking water pipes regularly and thoroughly. For this purpose, property owners should turn on the tap at the point furthest away from the water meter in order to flush the entire pipe if possible. Hot water pipes must be flushed at a temperature of at least 60 °C. Of course, the cold water pipes should also be flushed regularly to ensure drinking water hygiene.

There is a need for action

Make a plan for the crisis and against its effects. Inform yourself comprehensively and make use of all available support offers. The following collection of information should help you a little bit to find the possibilities that suit you best.

Most catering establishments are currently closed or offer a delivery and/or collection service at most. The first order of the day is therefore to reduce fixed costs. Please check the following possibilities:

  • Talk to your landlord or lessor regarding lease or rent reduction. Perhaps there are possibilities for cost reduction or deferral in a mutual sense.
  • Talk to your energy suppliers. Perhaps the monthly payments on account can be reduced, as consumption has fallen accordingly.
  • Check your monthly fixed costs with regard to termination options and potential savings.
  • Check orders that may have to be stopped or postponed.

Collect facts:

  • Compile documents that can be used to document the amount of the losses (bookings, reservations, etc.)
  • Make an extrapolation of the loss of turnover to be expected in the coming months.

Business interruption or loss of business insurance

Running costs in your company may possibly be covered by your insurance. Rent, interest, salaries, etc. would be included, for example. Loss of profits can also be covered by your insurance. Before you do this, however, you should check what is written in the policy. Only if you have an extended contingency insurance that explicitly includes losses due to pandemics or epidemics will the insurance cover become effective.

It is best to check your policies first and contact your insurance broker.

Compensation under the Infection Protection Act

The plant closures ordered by the state authorities, which are classified as measures "to combat communicable diseases", do not lead to claims for compensation under the Infection Protection Act (IfSG). Claims can only arise if your company is directly affected and has been placed in quarantine on the basis of an official decree.

The Landschaftsverband Westfalen Lippe (for the administrative districts of Arnsberg, Detmold and Münster) is responsible for information and applications in this regard for our region.

The city of Schmallenberg points out that tax deferrals or adjustments of advance payments on municipal taxes should be applied for promptly at the administration. Please note the letter from the city administration, which you can download using the link below.

Short-time work

Basic provision for self-employed persons

Anyone claiming a basic allowance for self-employed persons does not have to give up their self-employed or freelance activities. In contrast to social assistance, basic income support for self-employed persons is usually granted for a period of twelve months. From Friday, 27.03.2020, applications for support for the emergency aid programme of the State of NRW can be submitted. For companies at risk of insolvency, the Federal Ministry of Justice and Consumer Protection is currently drafting a legal regulation to suspend the obligation to file for insolvency. This regulation is intended to protect companies that get into financial difficulties as a result of the Corona epidemic.

GEMA

For licensees, all monthly, quarterly and annual contracts are suspended for the period during which they have to close their operations due to official orders to contain the spread of the pandemic. During this period, GEMA royalties are not payable. No licensee shall be charged with GEMA royalties for the period of closure. This measure applies retroactively from 16th March 2020.

When the school or daycare centre closes - can I stay at home to look after the child?
Parents must first make every reasonable effort to ensure that their children are cared for elsewhere. This can be done, for example, by taking care of the other parent. If this is not possible, the Federal Ministry of Labour appeals to all employers to agree pragmatic solutions with the employees concerned - for example by working at home, reducing overtime, taking leave or building up minus hours that can be worked off at a later date. In principle, an employer cannot prohibit home care.

Who pays my salary if I cannot find childcare?
If the school is closed because of the coronavirus pandemic, the child is healthy and there is no other possibility to accommodate the child, it is a personal prevention through no fault of your own. Parents must fulfil their duty of care. If the parents' collective or employment contract does not exclude it, the employer must continue to pay wages or salary for a few days. "Parents should not, however, hope to receive wages for more than two or three days", says Frankfurt labour lawyer Eva Wißler. If schools or daycare centres remain closed for a longer period of time, however, there is no legal entitlement to paid leave. Parents who have to look after their children therefore have no salary entitlement either.

What applies if my child is ill?
This case is regulated by social law. Parents have a legal right to limited leave of absence to care for their sick children. Up to ten days per parent may be missed for paid care. Single parents are entitled to up to 20 days.

Can I take my child to work with me?
You may only take your child to work with you with the express permission of your employer.

Do I have a right to work at home?
There is no legal right to a home office in Germany. However, employees can agree this with their employer. In this respect expert Wißler advises to talk to the employer: "Now solidarity and constructive agreements are needed The fear of an infection by the virus alone is not sufficient as a reason to work at home. This is part of the general life risk, explains the German Federation of Trade Unions.

Who pays if I fall ill with Covid-19 or am in quarantine?
In the event of illness, there is the usual entitlement to continued payment of salary. For the first six weeks, it is granted in the amount of the loss of earnings. From the beginning of the seventh week, it is paid at the level of sick pay. Even if quarantine is ordered, the employee continues to receive his or her salary.

Can the employer force me to use a home office?
If employers have reasonable suspicion of illness, they may send employees home - to protect the rest of the workforce. In this case, they may not demand home work. The salary will continue to be paid as in the case of real illness. An order to work from home is not permissible if home office has not been agreed upon anyway.

Do I have to report an infection in my environment to the employer?
In principle, the employer does not have to be informed. In the event of an epidemic, the situation is different in that the health authorities are informed of infections by the doctors and may then impose a quarantine, which may also extend to the company, for example.

What happens if the company closes or is closed?
If a company closes to protect its employees, the company bears the financial risk. Employees continue to receive their salaries, provided they are fit and willing to work. If the business closes due to a request of the responsible health authorities, the general compensation regulations according to § 56 of the Infection Protection Act apply. The compensation is calculated according to the loss of earnings. The amounts paid out will be reimbursed to the employer on application.

What do the self-employed receive?
According to the Infection Protection Act, self-employed persons and freelancers receive compensation for loss of earnings if they are no longer able to work due to the viral disease. According to the Federal Ministry of Health, the authority bases this on the profit that was determined in the tax assessment for the previous calendar year.
